Hehadalreadyhypothecatedforhisowndebtstheloanofthecityplacedinhishandsforsale—hehadunlawfullyobtainedfivehundredthousanddollarsincashasloans;anditisreasonabletosupposethathecouldobtainnothingmorefromthecitytreasurybyanyordinarymeans.Thenitisthathegoesthere,and,bymeansofafalsehoodimpliedifnotactual,obtainssixtythousanddollarsmore.Thejuryhasfoundtheintentwithwhichthiswasdone."
ItwasinthesewordsthatCowperwood’sappealforanewtrialwasdeniedbythemajority.
ForhimselfandJudgeRafalsky,JudgeMarvin,dissenting,wrote:
"ItisplainfromtheevidenceinthecasethatMr.Cowperwooddidnotreceivethecheckwithoutauthorityasagenttodoso,andithasnotbeenclearlydemonstratedthatwithinhiscapacityasagenthedidnotperformorintendtoperformthefullmeasureoftheobligationwhichthereceiptofthischeckimplied.Itwasshowninthetrialthatasamatterofpolicyitwasunderstoodthatpurchasesforthesinking-fundshouldnotbeknownorunderstoodinthemarketorbythepublicinthatlight,andthatMr.Cowperwoodasagentwastohaveanabsolutelyfreehandinthedisposalofhisassetsandliabilitiessolongastheultimateresultwassatisfactory.Therewasnoparticulartimewhentheloanwastobebought,norwasthereanyparticularamountmentionedatanytimetobepurchased.
