Attwoo’clocksharpDennisShannon,asdistrictattorney,beganhisopeningaddress.Hestatedinaverysimple,kindlyway—forhehadamostengagingmanner—thattheindictmentasherepresentedchargedMr.FrankA.Cowperwood,whowassittingatthetableinsidethejury-rail,firstwithlarceny,secondwithembezzlement,thirdwithlarcenyasbailee,andfourthwithembezzlementofacertainsumofmoney—aspecificsum,towit,sixtythousanddollars—onacheckgivenhim(drawntohisorder)October9,1871,whichwasintendedtoreimbursehimforacertainnumberofcertificatesofcityloan,whichheasagentorbaileeofthecheckwassupposedtohavepurchasedforthecitysinking-fundontheorderofthecitytreasurer(undersomeformofagreementwhichhadbeeninexistencebetweenthem,andwhichhadbeeninforceforsometime)—saidfundbeingintendedtotakeupsuchcertificatesastheymightmatureinthehandsofholdersandbepresentedforpayment—forwhichpurpose,however,thecheckinquestionhadneverbeenused.
