"Asamatteroffact,gentlemen,thereisnoessentialdifferenceintheevidencewhichtheprosecutioncanpresentandthatwhichwe,thedefense,canpresent.WearenotgoingtodisputethatMr.CowperwoodreceivedacheckfromMr.Stenerforsixtythousanddollars,orthathefailedtoputthecertificateofcityloanwhichthatsumofmoneyrepresented,andtowhichhewasentitledinpaymentasagent,inthesinking-fund,astheprosecutionnowclaimsheshouldhavedone;butwearegoingtoclaimandprovealsobeyondtheshadowofareasonabledoubtthathehadaright,astheagentofthecity,doingbusinesswiththecitythroughitstreasurydepartmentforfouryears,towithhold,underanagreementwhichhehadwiththecitytreasurer,allpaymentsofmoneyandalldepositsofcertificatesinthesinking-funduntilthefirstdayofeachsucceedingmonth—thefirstmonthfollowinganygiventransaction.Asamatteroffactwecanandwillbringmanytradersandbankerswhohavehaddealingswiththecitytreasuryinthepastinjustthiswaytoprovethis.TheprosecutionisgoingtoaskyoutobelievethatMr.Cowperwoodknewatthetimehereceivedthischeckthathewasgoingtofail;thathedidnotbuythecertificates,asheclaimed,withtheviewofplacingtheminthesinking-fund;andthat,knowinghewasgoingtofail,andthathecouldnotsubsequentlydepositthem,hedeliberatelywenttoMr.AlbertStires,Mr.
