AlanGoldsberryimmediatelyfiledanappealandbriefwiththe10thAppellateDistrictinFranklinCounty,Ohio,challengingSenateBill297(theMilliganlaw)asadenialofequalprotectionofthelawandadenialofdueprocess,andthereforeunconstitutional.HealsoarguedthatitsapplicationtoBillyMilligan"retroactively"wasaviolationoftheOhioconstitution’sprotectionagainstretroactivelaws.
