Burchandhiswitnessesappearedincourt,andH.B.Northupappearedascounselforthecoloredman,statinghewasreadytoproceedascounselonthepartofthedefendant,andaskingnodelaywhatever. Burchdeliveredthemup,andthecourtrenderedajudgmentofdiscontinuancebytherequestoftheprosecutor,andfileditinhisoffice."
