Theprisoner’scounselsawthenecessityofexhibitingit,orgivingsomereasonableexplanationforitsnon-production.Toeffectthelatter,Burchhimselfwasofferedasawitnessinhisownbehalf. Itwascontendedbycounselforthepeople,thatsuchtestimonyshouldnotbeallowed—thatitwasincontraventionofeveryruleofevidence,andifpermittedwoulddefeattheendsofjustice.
